Under the direction of the General Counsel, the Associate General Counsel, assists on a variety of legal matters relevant to MATC operations. Legal matters include litigation, employment and labor, FMLA, EEO, Title IX, and ADA law, contracts, copyright issues, compliance issues, student law issues, public records and open meetings laws and district policies and procedures. Work requires the exercise of considerable initiative and independent judgment of a confidential nature needed to carry out all Office of General Counsel activities.
Characteristic Duties and Responsibilities
- Legal Support and Oversight: Aids in the management of the Office of General Counsel. Provides support to the General Counsel by identifying and researching state and federal legislation, administrative and court decisions, analyzes and recommends those that impact the college. Offers legal support on a variety of college-related issues including but not limited to regulatory compliance, personnel issues, copyright, public record requests, student complaints and other college policy and procedure issues.
- Litigation Support: Manages and coordinates all phases of litigation matters while partnering with outside counsel as needed to develop case strategy, review pleadings, and prepare key documents. Conducts legal research, drafts memoranda, prepares and responds to discovery requests, and conducts depositions as needed. Prepares witnesses for testimony, evaluates settlement options, and provides recommendations to leadership. Manages e-discovery, legal holds and provides regular status updates. Looks for opportunities to improve office efficiencies and seeks alternative dispute resolution options.
- Conduct and Complaints: Provides effective management as it relates to student conduct and complaints. Reviews and investigates complaints in a timely and efficient manner while maintaining discretion and confidentiality.
- Risk Management: Oversees the risk management efforts of the district through oversight of insurance policies and applicable regulatory compliance.
- Contract Review and Administration: Assists in reviewing and drafting board resolutions, contracts, leases, board policies, administrative procedures, and other district legal documents.
- Policy Development and Metrics Review: Interprets local, state, federal and other regulations and laws applicable to the district, and requirements for compliance; assists in developing compliance policies and processes. Reviews, analyzes, and assists in drafting college policies, administrative procedures, and standard operating procedures. Assists in the coordination of cyclical reviews of college policies and administrative procedures.
- Committee Participation and System Engagement: Chairs or serves on appropriate college committees as directed by the General Counsel.
- Ethics and Confidentiality: Practices honesty by demonstrating a consistent and uncompromising adherence to strong moral and ethical principles, values, truthfulness and accuracy in all actions. Addresses all student and employee behavior in a confidential and respectful manner.
- Cross Functional Relationships and Collaborative Teamwork: Collaborates with various stakeholders, external counsel and other vendors to obtain and exchange information and documentation related to legal, and operational matters, including responding to public records requests, processing contract review requests and drafting documents.
- Continuous Learning & Professional Development: Maintains current knowledge of best practices and standards in higher education with an emphasis on community Colleges. Actively organizes and/or participates in applicable workgroups, trainings, workshops, seminars, committees and professional associations or conferences to promote continuous learning.
- Other duties: Performs other related duties within the scope of the position as required for the efficient operation of the division and to support institutional objectives.
Knowledge, Skills & Abilities
- Comprehensive knowledge and experience in preparing, reading and interpreting legal correspondence and legal documents, as well as policies and procedures, personnel documents, financial reports and documents.
- Strong cross-cultural communication and conflict resolution skills needed to navigate complex situations to resolve problems, build consensus, and reconcile competing interests.
- Extensive knowledge and experience working in a multi-department organization which requires working with multiple stakeholders, including executive level professionals.
- Ability to effectively administer and supervise the daily operations of an office setting.
- Ability to multitask, manage multiple projects, prioritize high-priority assignments and meet deadlines.
- Ability to use computer software and programs relevant to the position including the ability to utilize databases, student information systems and the Google Office Suite.
- Ability to communicate effectively, persuasively and analytically both through written and oral means across all levels of employees, management and with students.
- Ability to provide leadership and strong supervisory and management skills and experience.
- Ability to establish, collaborate and maintain effective work relationships with peers, students, teachers, staff, representatives of outside agencies, educational institutions, and the general public.
- Ability to convey an image of professionalism and dedication in work related activities.
- Ability to work with culturally diverse student and employee populations.
Qualifications
Compliance with all state, federal, and accreditation standards/requirement, as well as all MATC policies and procedures.
Required Education & Experience: Juris Doctor (J.D.) and six (6) years of progressively responsible work experience including some exposure to litigation, risk & compliance, accommodations, employment/labor relations, FERPA real estate or other similar legal experience.
Required Licensure/Certification: Eligibility to obtain a license to practice law in Wisconsin within six (6) months of hire.
Supplemental Information
The department operates Monday through Friday from 8:00 a.m. to 5:00 p.m. Flexibility is required, as the position may involve occasional evening or weekend hours and travel to other campus locations.
Salary Information Salary is listed to the midpoint of the range and placement is determined based on years of experience, internal salary equity, and a review of the applicant's employment and educational background as listed on the fully completed job application.
